TERMS OF SERVICE

By commissioning me, you are stating that you have read and agreed to these terms.Basic ToS:
I as the artist, reserve the right to deny ANY commission for any reason, if I decide I can no long complete a commission, you will be refunded based on the amount of work completed. Read below for clarification.At least half payment must be sent if the commission is priced over $100 USD. If the commission is less then that, the client may send it at any time. However I will not send the final work until I am compensated.
I accept through Kofi, Booth, Stripe & Paypal only.Commissioner can re-upload the image with credits given to myself in any form.
Artwork is priced to include commercial use, so you may use any and all commissions you buy from me commercially.BY ORDERING ANY NSFW/18+ ART YOU ARE AGREEING THAT YOU ARE 18 OR OLDER.

SECTION I. IMAGE COPYRIGHT
I, the artist, retain full and exclusive rights to the original artwork. The client may not claim it as their own.Conditions for Reposting
The client has my permission to repost the artwork wherever they would like, as long as proper credit is given (a link back to my twitter or my @ on Twitter)Prohibited Actions
-Claiming the artwork as your own
-Altering the artwork in ways that would make it unrecognizable from the original work
If these terms are broken, you will be privately blacklisted from commissioning me and reported.SECTION II. PAYMENT INFORMATION
I accept payment in USD through Kofi, Booth, Stripe & Paypal Exclusively. The client must send at least half payment if the commission is over $100 USD. If the commission does not go over that $100 USD limit, the client may send the payment at any point during the commission. However I cannot send the final image without compensation.It is the commissioner's responsibility to tell me when the payment has been sent. Sometimes a payment will fall through and I won't know about it, so please keep me as updated as possible.Refund Policy
If the commission is cancelled (by me or the client) before work has started, then the client will receive a full refund.If the client cancels the commission during progress, the amount refunded will be on a case-by-case basis and up to the artist’s discretion.I do have a rough basis for refunds:
Sketch: 90%
Line: 50%
Line and Flat Color: 10%No refunds will be given for completed or nearly completed commissions.The artist reserves the right to cancel a commission at anytime, for any reason, and without explanation.
If I, the artist, cancels the commission due to my inability to complete it at any state, a full refund will be given.SECTION III. CONTACT AND COMMUNICATION
Discussion of commissions can be conducted via Twitter DMs or Discord. Most of my communication is done via Twitter DMs, however my Discord is "riolaistrying" if you need to contact me there. Once a commission is completed, I will ask the client for an email I can send the artwork to.Visual Reference Guidelines
Client must provide at least one clear and concise visual reference of the character desired; please supplement the visual reference with any important information I may need to know to correctly draw the character.If you link to a gallery of your character’s artwork, I cannot promise your design will be done with 100% accuracy. Design interpretations may be inconsistent between images and lessen my ability to accurately draw your character.Shading on potential pieces will also play a part in this. If at all possible please provide a unshaded piece of work so I can accurately represent colors.You will only be allowed to change things within the sketching process so please voice any concerns thenSECTION IV. I am an Australian citizen and abide by Australian laws.Breaking this rule is extremely serious and will result in blacklisting/blocking on all social media, email, and any other means of contact.By ordering anything 18+/NSFW you are agreeing that you are at or above the age of 18.Confirmation via an ID may be required to confirm to myself that you are in fact legally considered an adult. If asked for some sort of confirmation, and if this request is refused, I will not take the commission. I won't ask unless I have reason to believe that you may not be an adult.SECTION V. WORKFLOW PROCESS
I work best when given some artistic freedom to create an image based on the characters you provide, but if you have something specific in mind, I am more than capable to conform to your needs.
If there are any delays in completion of a commission, I will personally notify the client.Completion of most commissions are generally estimated to take no more than roughly 1 to 2 weeks at the most. But that can be subject to change based on how many clients I have at the time, what's going on in my personal life, or communication issues with the client.For the fastest turn out time, please be patient with me, and try to communicate with me as much as possible. I'd rather take longer on your commission to get something that you are happy with, rather than quickly creating something nothing like what you originally wanted.If for any reason I cannot complete a commission, I will inform the client, and issue a full refund.Works in Progress (WIPS): All commission types include a sketch approval stage. I will send any wips to the commissioner if asked, or If I do anything significant to change or alter an artwork.Progress will be paused until the sketch is confirmed.Revisions and edits:
Any major changes or revisions must be made at the Sketch approval stage; this includes any significant changes to a character’s pose, body shape, or redrawing parts of the image.After the sketch has been approved, no major edits or changes will be made to the pose or the character. If the commissioner requests additional major edits after the approved sketch, a price for the edits may be discussed.If I, the artist, make any errors in the character design, accessories, or any other visual elements specified in the provided visual references, I will make these edits at no additional cost.If you do not want me to post your commission online in the form of WIPS, or if you want to post the final product first for any reason, you must tell me when you order.Thank you for your interest in my artwork.
